Senior Intellectual Property Attorney / Of CounselPosition OverviewWe are seeking a Senior Intellectual Property Attorney / Of Counsel to join our IP practice and provide highlevel legal advice across litigation, transactions, and counseling matters. The role will lead complex IP disputes and transactions, support M&A and due diligence processes, and advise clients on strategic protection, enforcement, and commercialization of patents, trademarks, copyrights, and trade secrets. The ideal candidate combines deep technical and legal experience with strong trial and client development skills and will serve as a senior advisor to both clients and firm teams.Key ResponsibilitiesLead and manage complex IP litigation matters, including trademark litigation, copyright disputes, patent litigation, trade secret cases, and trial preparation and strategy.Handle IP transactional work such as licensing, technology transfers, joint ventures, and IP-related provisions in commercial agreements.Conduct and supervise IP due diligence for M&A transactions and investment deals; draft and negotiate IP representations, warranties, and indemnities.Advise clients on IP prosecution strategy, including oversight of trademark prosecution and coordination with patent prosecutors as needed.Provide counseling on IP portfolio development, enforcement strategies, clearance opinions, freedom-to-operate analyses, and risk mitigation.Manage and mentor associates and paralegals, delegating work, reviewing filings and briefs, and developing junior talent.Draft and argue dispositive motions, appellate briefs, settlement agreements, and trial exhibits; lead or support witness preparation for depositions and trials.Negotiate settlements, licenses, coexistence agreements, and other resolutions to contentious IP matters.Partner with business development teams to cultivate client relationships, pursue new mandates, and represent the firm in conferences and industry forums.Coordinate with outside counsel and cross-disciplinary teams (corporate, regulatory, tax) to deliver integrated client solutions.QualificationsJuris Doctor (JD) from an accredited law school and bar admission in NYMinimum 10 years of focused intellectual property experience, with significant experience in both IP litigation and IP transactions in a law firmProven track record in trademark litigation, trademark prosecution, copyright matters, and trade secret disputes.Substantive experience with patents and patent-related issues, including coordinating with patent prosecutors and technical experts.Demonstrated experience conducting IP due diligence for M&A and advising on transactional IP risk allocation.Strong trial experience or trial readiness, including leading or supporting trials and evidentiary hearings.Experience drafting high-quality pleadings, motions, licensing agreements, settlement documents, and IP opinions.Excellent client-facing skills, business judgment, and ability to manage senior client relationships and develop new business.Ability to supervise and mentor junior lawyers, manage multiple matters and deadlines, and deliver commercially pragmatic advice.Exceptional written and oral advocacy skills and the capacity to work collaboratively across practice groups and with technical experts.Willingness to travel as required for trials, depositions, client meetings, and business development.Benefits- Medical, dental & vision insurance- 401k- PTO- Bonus- Hybrid - Growth opportunities- Competitive Salary ($225,000-$250,000/year DOE)
